Summary:
The article purpose is to point out individual problems of citizens with health disorders, their effort in social integration and problems of claiming their legal rights in every day life situations. At the same time it aims to clarify the basic legislative framework of the Slovak Republic dealing with the protection of human rights of the disabled people which is constantly growing in legislative terms. However, it is necessary to realize that these regulations need to be implemented as much as possible in everyday practice.
Reviewer's comments on the document:
For the needs of the project it means giving a form to the integration needs and respecting the principle of equality. It means that every human being hould have an equal opportunity (not the same level automatically) to execute his own life plans and ideas. He should have comparable conditions with others. He shold be able to execute his life vision by developing his own iniciative.
The second mentioned concept in SR is managed within the system of social aid as a form of solution to social shortage reparation of social consequences of the severe health disorders. Nowadays this area is covered by the Act no. 447/2008 of Slovak legislature about the financial aid for reparation of the severe health disorders and about the changes and appendices of some acts. It has been valid since January 1, 2009.
Legislature of Slovak republic forbids direct as well as indirect discrimination on the base of health disorder. This exact definition can be fouond in the Act no. 365/2004 of Slovak legislature about equal treatment in some areas, protection from discrimination and about the changes and appendices of some acts (e.g. the Antidiscrimination act) which has been valid since May 2004.
